Acceptance of terms
These Terms of Service (“Terms”) are a contract between you and PlutusAI LLC (“CapCue”, “we”, “us”) and govern your access to and use of CapCue’s desktop application and website (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The service
CapCue generates real-time captions from your computer’s system audio and provides related features such as session history, AI-assisted interview support, session summaries, stealth mode, and optional calendar integration. We may add, change, or remove features over time.
Accounts and eligibility
You must provide accurate information when creating an account and are responsible for activity under your account and for keeping your credentials secure. You must be old enough to form a binding contract in your jurisdiction.
Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms. In particular, you are responsible for obtaining any consent required by law before capturing or transcribing audio that includes other people, and for ensuring that your use of features such as interview support and stealth mode complies with all applicable laws and with the rules of any interview, examination, employer, or other third party that may apply to you.
You agree not to misuse the Service, including attempting to disrupt or reverse-engineer it, circumventing usage limits or security, or using it for unlawful or deceptive purposes.
Plans, billing, balance, and referrals
Some features require a paid plan. Paid plans and account balance are described on our pricing and billing pages, and charges apply according to the plan you select. Account balance and referral rewards may be applied toward eligible charges and have no cash value.
Referral rewards are granted only for genuine sign-ups that meet the stated qualification criteria; we may withhold or reverse rewards we reasonably believe result from abuse.
Refunds, cancellations, and how billing works are described in our Refund & Cancellation Policy. Except as stated there or as required by law, fees are non-refundable.
Third-party services
The Service relies on third-party providers (for example, AssemblyAI for transcription, OpenAI for interview support and summaries, authentication and hosting, email, and optional Google Calendar access). Your use of connected third-party services is also subject to their terms, and we are not responsible for them.
AI features and output
CapCue uses artificial intelligence to generate captions, session summaries, and interview-support suggestions (via providers including AssemblyAI and OpenAI). AI output is produced automatically and may be inaccurate, incomplete, biased, or otherwise unsuitable. It is provided to assist you, not to replace your own judgment.
You should review AI output before relying on or acting on it, and you must not rely on it where accuracy is critical (for example, legal, medical, financial, or safety-related decisions). You are responsible for how you use AI output.
Ownership: as between you and CapCue, you own the captions, summaries, and suggestions generated for you, to the extent permitted by law and subject to the terms of the underlying AI providers. You are responsible for ensuring your use of AI output complies with those providers’ terms and with applicable law, and you may not present AI output in a way that is deceptive or that violates rules that apply to you (see our Acceptable Use Policy).
Your content
Caption transcripts and recordings you create are yours and are stored locally on your device unless you use a feature that processes them on our behalf (such as interview support or summaries). You are responsible for your content and for how you use it.
Intellectual property
The Service, including its software, design, and trademarks, is owned by CapCue and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind. Captions and AI-generated answers and summaries are produced automatically and may be inaccurate, incomplete, or unsuitable for your purpose; do not rely on them where accuracy is critical. We do not warrant that the Service will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, CapCue will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
Indemnification
You agree to indemnify and hold CapCue harmless from claims, losses, and expenses arising out of your use of the Service or your violation of these Terms or applicable law, including any claim relating to recording or transcribing others without required consent.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.
Governing law and disputes
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. You agree that the courts located in the State of New York, United States will have exclusive jurisdiction over any dispute arising from these Terms or the Service, except where prohibited by applicable law.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the “last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
